Terms and Conditions for General Sales 2010 

The following communication replaces and cancels any previous communication, agreement or condition. 

With the aim of providing an ever-improving level of customer service, Binetti s.p.a. would like to announce its terms and conditions for all general sales, which come into force with immediate effect.

Present general sales conditions will be applied in whole to each individual order. Any exception to these conditions for any given order will be communicated to the client in writing by Binetti s.p.a. 

The confirmation of an order automatically implies the acceptance of the general sales conditions in place at the time of the confirmation of the order.

1.   SALES PRICES

Apart from where otherwise indicated, Binetti s.p.a. product prices do not include V.A.T. Every newly published price automatically replaces and cancels previous prices for the same product, and are dependent on the availability of the said product.

Binetti s.p.a. reserves the right to confirm or modify at any given time product prices communicated on its website, or on any other advertising or marketing material, even at the moment when an order is confirmed.

Any technical information regarding any Binetti s.p.a. product which is communicated via promotional material is identical to that communicated to Binetti s.p.a. by the product manufacturer. Binetti s.p.a. does not accept any responsibility with regards to the authenticity or integrity of such technical information.

Binetti s.p.a. products cannot be ordered on a trial basis. Notwithstanding the fact that Binetti s.p.a. staff can provide technical product information if required, the Customer is responsible for the choice of the ordered product, as well as for the compliance of the ordered product in relation to the technical information provided by the product manufacturer.

Any price communicated by Binetti s.p.a. in response to a request for quotation by a customer is valid on average for between 5 and 10 working days, with the exception of any exceptional prices communicated to the Customer by Binetti s.p.a. Price quotations for any products which Binetti s.p.a. needs to order from its supplier will also include an estimated order execution date as well as an indication of the product availability.

Product price quotations can only be requested via fax or email.

2.   ORDER ACCEPTANCE AND EXECUTION

�          MORNINGS

All ORDERS received before 12:15 will be accepted and executed as usual.

Any  ORDERS received between 12:15 and 13:00 will be executed in the afternoom of the same day.

�          AFTERNOONS

All ORDERS received before 17:45 will be accepted and executed as usual.

Any  ORDERS received between 12:15 and 13:00 will be executed in the morning of following working day.

 3.   METHOD OF DELIVERY

The Customer is responsible for all delivery costs related to the purchase of products from Binetti s.p.a. Deliveries are carried out using courier companies under contract to Binetti s.p.a. All orders are therefore charged to the customer on a “door-to-door” basis, with delivery costs being included on the purchase invoice.

In the case of a “payment on receipt” delivery using one of the aforementioned courier companies, goods will only be released by the courier after receipt of payment for the order. All payments must be made by the Customer, with the exact amount in cash. The cost of delivery in this case is the responsibility of the Customer and must be made to the courier company at the time of delivery. Any other form of delivery or any delivery made by a courier company not under contract to Binetti s.p.a. must be paid for at the time of delivery.

The average delivery time for Binetti s.p.a. deliveries is from 24 to 48 hours for all items already available in-stock at the Binetti s.p.a. warehouse. The delivery time for any items not already available in-stock at the Binetti s.p.a. warehouse will be communicated when the order is confirmed. Any eventual delay in delivery of less than 15 working days does not give the Customer the right to refuse acceptance of the delivery, nor to request any form of compensation.

4.   PRODUCT RETURNS

Product returns can only be carried out upon request using the following Product Return Authorization Request form, to be sent by fax to +39.080.3739437. Upon receipt of the Product Return Authorization Number, the product return process can begin as described below. Any product return carried out without a Product Return Authorization Number will be automatically refused.

It is obligatory to fill-in a Product Return Form, completing all the required fields :

2 kinds of Product Return are possible:

-         Mistaken Order : on receipt of the Product Return Authorization Number, the completed Product Return Form must be received by Binetti s.p.a. within 3 working days from the day of purchase, while the returned product must be received by Binetti s.p.a. within 5 working days from the day of purchase. The mistaken order must be clearly explained.

-         Faulty Product : the completed Product Return Form along with the apparent faulty product will be sent by Binetti s.p.a. to the product supplier for evaluation. Binetti s.p.a. will then receive the relevant analysis of the product from the supplier, and will act accordingly depending on the result of this analysis.

NB:·        All product returns must be accompanied by a Product Return Form.

·     Binetti s.p.a. will be responsible for the delivery costs for any Mistaken Order Product Return, while the delivery costs for any Faulty Product Return will be the responsibility of the Customer. In the case of a Faulty Product Return being recognised by the product supplier, Binetti s.p.a. will credit the Customer with all the relative costs (cost of product + cost of delivery).

·     It is not possible to include a Mistaken Order Product Return and a Fault Product Return in one single request. In such a case, 2 separate requests must be made using 2 separate request forms.

·     Product Returns and all related issues can not be handled by Binetti s.p.a. sales personnel, and can only be carried out following the aforementioned process.

·     Any Product Return which does not follow the aforementioned process will automatically be refused.

·     Mistaken Order Product Returns are only possible for products ordered via fax or email. Product reference numbers must be clearly legible on any written orders. Any products ordered via telephone are not eligible for Mistaken Order Product Returns. Any Mistaken Order Product Returns for products ordered via telephone will automatically  be refused.
